Samsung and Apple has engaged in a fierce battle about patent smartphones and tablets since last April, and it marked the first time the legal tussle has postponed the launch of Samsung products.

Patent dispute with Apple Inc. to delay the launch of Samsung Electronics' latest Galaxy tablets in Australia, a setback for South Korean company's efforts to close the gap with Apple in the middle of the tablet market is booming.

Apple accuses line of Samsung mobile phones and tablet Galaxy "booming" mimic the iPhone and iPad giving rise to lawsuits in the United States, Australia, and elsewhere.Samsung has filed suit against Apple back.

On Tuesday, Samsung said it has agreed with Apple not to sell teblet variant in Australia.

"A Galaxy Tab 10.1 (inches) for the Australian market will be released in the near future. This business does not affect other Samsung smartphones and tablets are available in the Australian market as well as other countries," Samsung said in a statement.

The lawsuit against Samsung in Australia registered with the Federal Court in Sydney.

Gadget Galaxy is seen as one of the biggest challenger to Apple's mobile devices, but Samsung has so far not able to approach the roaring growth in sales of the company's Silicon Valley.

Last month, Samsung launched a much thinner and lighter version of the tablet Galaxy in the domestic market (South Korea) were profitable, try to take over the blockbuster sales of the Apple iPad.

"The point is if this (lawsuit) is only in Australia, then it will not move the needle too much," said Bryan Ma, an analyst at industry research firm IDC in Singapore.

"If only in Australia, it is only a fraction of the global market," he said.

IDC said shipments of media tablets into Australia only 2.4 ersen of global shipments totaled 7.2 million units in the first quarter of this year.

Sharpening a dispute between Samsung and Apple has fueled expectations of relationships (business) are both worth over 5 billion dollars up for grabs. Samsung regard Apple as the largest customer and make spare parts central to Apple's mobile devices.

According to the Federal Court document, the contents of the Apple lawsuit trying to prevent the Samsung to "import, promote ... offer to sell or sell the Galaxy Tab 10.1 in Australia", unless he has approval from Apple or the courts.

Apple also requested that all samples of the Galaxy Tab 10.1 shipped to Apple so that it can be destroyed, court documents said.

"This does not mean that we will not sell the Galaxy until the legal case ends. We will sell when certain conditions are met as we continue talks with Apple," said a spokesperson from Samsung.

The next hearing in the Federal Court determined was held on August 29, as quoted by Reuters.

A spokesman for Samsung in Australia said, the actual launch date was August 11 in the country but this has not been resolved and the company is only delaying the launch.
